A. General Provisions (Website, Information & Services)

1.1 These Terms and Conditions (T&C) apply to all services, inquiries, offers, and information provided through the website etswiss.ch as well as associated platforms operated by ET Swiss AG. This includes:
– Tourism & Destination Management (DMC) services
– Chauffeur & transportation services
– Logistics, warehousing & mandate services
– Trade-related services
– Any other services offered or facilitated by ET Swiss AG

1.2 The website contains extensive informational content. A legally binding contract is formed only once ET Swiss AG issues a written confirmation or official offer accepted by the client.

1.3 “Client” refers to any natural or legal person using our services or requesting information.

1.4 Client terms and conditions apply only if explicitly accepted in writing by ET Swiss AG.

2. Formation of Contract (Services)

2.1 All information, prices, and descriptions on the website are non-binding and serve as guidance only.

2.2 A contract is concluded only when ET Swiss AG provides a:
– written confirmation,
– email or WhatsApp confirmation,
– or a formal invoice/payment link accepted by the client.

2.3 ET Swiss AG may decline bookings for operational, safety, or regulatory reasons.

3. Scope of Services

3.1 The scope, content, and specifics of the booked services are defined exclusively in the official offer and the booking confirmation.

3.2 ET Swiss AG reserves the right to modify routes, schedules, or procedures due to traffic, safety requirements, operational needs, or governmental measures. Clients will be informed as early as possible.

3.3 For logistics and transport services, industry standards (e.g., SPEDLOGSWISS) may additionally apply.

4. Prices and Payment Terms

4.1 Prices on the website are indicative unless explicitly stated as binding.

4.2 Only the prices stated in the written offer or booking confirmation are legally binding.

4.3 Payments may be made via the payment methods indicated on the website (e.g., credit card, bank transfer, online payment link).

4.4 All services remain the property of ET Swiss AG until payment has been made in full.

5. Client Responsibilities

The client agrees to:
– provide accurate and complete information necessary for service delivery
– comply with safety instructions and regulations
– ensure punctuality and proper conduct
– immediately inform ET Swiss AG of changes or delays

Damages arising from improper behaviour or incorrect information are the client’s responsibility.

6. Liability of ET Swiss AG

6.1 ET Swiss AG is liable only for damages caused intentionally or through gross negligence.

6.2 Liability for slight negligence is excluded to the extent permitted by law.

6.3 ET Swiss AG is not liable for indirect or consequential damages, such as lost profits or business interruptions.

6.4 For third-party services (hotels, guides, transport companies, logistics partners), ET Swiss AG acts as an intermediary; liability lies with the respective provider.

7. Force Majeure

Events such as natural disasters, pandemics, governmental restrictions, strikes, or other unforeseeable circumstances may require ET Swiss AG to adjust, postpone, or cancel services. In such cases, the client will be informed, and solutions will be offered where possible.

8. Amendments to the T&C

ET Swiss AG reserves the right to amend these T&C at any time. The applicable version is the one valid at the time of contract conclusion.

9. Applicable Law & Jurisdiction

Swiss law applies.
Jurisdiction—where legally permitted—is Aarau, Switzerland.

B. Special Provisions for the Online Shop

(The following conditions apply only to transactions made in the integrated shop section.)

10. Contract Formation (Shop)

10.1 Product listings do not constitute a binding offer.

10.2 By submitting an order, the client places a binding purchase offer.

10.3 The contract is concluded once ET Swiss AG issues a payment or order confirmation.

11. Prices, Shipping & Delivery

11.1 Shop prices are shown in Swiss Francs (CHF) and include VAT unless otherwise stated.

11.2 Shipping costs and applicable customs charges are displayed before checkout.

11.3 Delivery times are non-binding unless specifically confirmed in writing.

12. Returns, Withdrawal & Exchanges

12.1 Swiss law does not provide a statutory right of withdrawal for online purchases.

12.2 Returns or exchanges are only possible if ET Swiss AG voluntarily offers such options.

12.3 For EU-based customers, statutory consumer rights (e.g., 14-day withdrawal) may apply; this will be communicated in the order confirmation.

13. Defects & Warranty

13.1 Customers must report defects immediately and in writing.

13.2 Warranty rights follow Swiss law. Unless otherwise indicated, warranty periods for goods are 2 years.

14. Retention of Ownership

All goods remain the property of ET Swiss AG until fully paid.

C. Data Protection

Personal data is processed according to the Privacy Policy published on etswiss.ch, in accordance with Swiss data protection law and—where applicable—the EU GDPR.

D. Final Provisions

Should any clause of these T&C be invalid, the remainder remains unaffected. The invalid clause will be replaced by one that comes closest to its commercial intent.
